A statement from the Southern Environmental Law Center regarding the Navy’s filing of an appeal in the 4th Circuit Court of Appeals.

The Navy is appealing Federal District court Judge Terrence Boyle’s decision issuing a permanent injunction against its plans to construct an Outlying Landing Field (“OLF”) in Washington and Beaufort Counties, North Carolina

At some point the Navy must acknowledge it made a mistake in choosing this site for a landing field, a fact the rest of the world appears to understand. Instead of working to find an alternative site for an OLF, or performing the necessary environmental reviews as the law requires, the Navy has decided to spend its time and taxpayers’ money to continue this fight in court. The Navy’s poor planning and inadequate analysis have put the environment and the communities of northeastern North Carolina at risk. We are confident that the appeals court will uphold Judge Boyle’s decision and require the Navy to comply with the law before it proceeds with further development of a landing field in North Carolina.
